Jason Rosenthal, chair of Much’s Commercial Litigation group, spoke with Bloomberg Law on the practical effects of the Illinois Supreme Court’s highly anticipated ruling that the Illinois Biometric Privacy Act (BIPA) claims are governed by a five-year statute of limitations, rather than a one-year statute.
He believes the ruling is unlikely to have substantial liability increases on companies facing claims under the act because “most claims under the statute that would have had a one-year statute of limitations period under the court of appeals ruling were paired with claims that had a five-year statute of limitations period.”
