Jason Rosenthal, chair of Much’s Commercial Litigation group, spoke with Law360 about a recent amendment to the Illinois Biometric Information Privacy Act (BIPA). The amendment clarifies that a company commits a single BIPA violation by unlawfully collecting biometric data from the same person multiple times, rather than accruing violations for each collection.
Rosenthal explained that while the amendment will remove the existential threat BIPA class action lawsuits present to many companies, those doing business in Illinois should still be vigilant.
